*1154Plaintiff thereafter commenced this action in Supreme Court seeking a divorce on the ground of cruel and inhuman treatment.* In a pro se answer, defendant entered a general denial and requested a jury trial, asserting that, among other things, he would be making a counterclaim for divorce at a future date. Plaintiff then moved for summary judgment, and requested that the court dismiss all of defendant’s counterclaims.
