This appeal is from a judgment in favor of the appellee for $23,000 as damages for personal injuries. On May 4, 1915, the appellee was a brakeman in the service of the Kansas City Southern Railway Company, and was a member of a crew operating a freight train between Port Arthur, Tex., and Leesville, La. As the train passed through the town of Hartsburg, going north, and while the appellee was walking on top of the cars, going toward the front end, he came in contact with the telephone wires belonging to the appellant and received the injuries for which he sues.
