In this action by plaintiff Brenda Adelman, as executrix of the estate of Barbara Adelman, deceased (plaintiff), to recover damages for wrongful death, defendant Gerald Adelman (defendant) moves, after trial, for an order, pursuant to CPLR 4404 (a), setting aside the jury verdict to the extent that it awarded punitive damages to plaintiff, and dismissing the complaint.
