DECISION AND AMENDED ORDER
MARRERO, District Judge.
Plaintiff filed this action on July 9, 2001, alleging, inter alia, claims of fraud and unjust enrichment against the defendants. Plaintiff farther alleged that the Court’s subject matter jurisdiction over the action was based on a diversity of citizenship between the parties, pursuant to 28 U.S.C. § 1332.
