Fox, Judge:

B. R. Cottrill complains of a decree of the circuit court of Cabell County in favor of the New York Life Insur- anee Company for the sum of $4,187.50, with interest on' $3,000.00 thereof from September 16, 1936, entered upon the answer of said Insurance Company, praying for affirmative relief, in a chancery cause pending in said court in which Cottrill was plaintiff, and First Huntington National Bank, trustee, Mutual Company and New York Life Insurance Company were defendants, which decree provided for the sale of certain real estate owned by said Cottrill.
