Tbe appeal is from a decision of tbe Commissioner of Patents sustaining opposition to, and denying tbe registration of a trademark. ■

On May 25, 1905, Wm. A. Pogers, Limited, a corporation of tbe Province of Ontario, Dominion of Canada, applied for ’ the. registration of a trademark consisting of tbe words “Wm. A. Pogers,” used in tbe manufacture and sale of silver-plated -flat ware,, hollow ware, and table ware.
