The first is from a judgment of the Rockcastle circuit court rendered on June 28, 1930, sustaining a demurrer to and dismissing the petition of appellant Parsons, who instituted this action for the benefit of himself and all other taxpayers of Rock-castle county, for the purpose of enjoining the collection of an alleged illegal tax levied by the fiscal court.
