POEEENBARGER, JUDGE:
The general nature of the contract, involved in this cause, is set forth in the report of a former decision here, on .another *563appeal, found in 61 W. Va. 183. Tin's appeal is from a final decree, requiring; Henrieyto convey to Henderson a. portion of the land, purchased by him at the judicial sale, by way of specific performance of the verbal agreement, constituting the basis of the suit.
