Appellant in this case was convicted in the court below of murder in the second degree, and his punishment assessed at confinement in the penitentiary for a term of eleven years, and from the judgment and sentence of the lower court he prosecutes this appeal. The appellant assigns as error that the court erred in failing to sustain his exceptions to the transcript and to the order of the court changing the venue of this case from the District Court of Mason County, because he says that the record fails to disclose how the case got into Mason County, and because the…
