The Reporters'1 statement of the case: This case was referred to Alexander A. Hosmer, esq., referee, and was heard upon exceptions to his report. The court disregarded the report, and found the following facts I. The claimant Barnes and defendant (by the Board of Public Works) entered into contracts in writing, duly made and signed, as required by the Act of February 21,1871, chapter 62, section 37 (16 Stat. L., 427), and extensions of the same (the first by said Board and all the others by the Commissioners), at their respective dates, omitting such portions as are not material in this case.…

delivered the opinion of the court:

The claimant Barnes entered into two written contracts with the Board of Public Works to do a large quantity of work upon different streets in Washington at a scale of prices specifically stated. These contracts, set out in Finding I, dated respectively April 29, 1872, and July 23, 1872, were made in *383conformity with, the provision of the original act establishing the Board (Act of February 21, 1871, ch. 62, sec. 37, 16 Stat. L.3 427), which required that
