— Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Warren County) to review a determination of respondent Commissioner of Health which found that petitioners had violated the provisions of article 34 of the Public Health Law and, accordingly, imposed a penalty on petitioners of $1,000.
