HENDERSON, Judge.

Appellant was convicted, under article 309, Penal Code, of being engaged in an unlawful assembly, with other persons, with intent to interfere with the occupation and employment of another, and his punishment assessed at a fine of $35.

Appellant assigns a number of errors, but it is only necessary to notice one.
