This is an appeal by the shipowner, A/S Gerrards (“Gerrards”), from a decision of the Bankruptcy Court granting summary judgment to the Trustee of the estate of Sterling Navigation Co. (“Sterling”), on a motion to declare invalid a shipowner’s maritime lien on subfreights which had not been perfected under Article 9 of the New York Commercial Code (“Article 9 of the Code”).
