Indictment for murder. The record, shows that at six o’clock, P. M., on Saturday, November 13,1858, being the last day of the November term of said Court, the jury impanneled in this case returned into Court, and *449informed the Court that there was no probability of their agreement as to a verdict; and the Court, having inquired of the parties if they would consent to a discharge of the jury, and the defendant having refused such consent, the judge adjourned the Court until Monday of the next week, being Monday, the 15th of November, and directed the jury to be kept confined until that time,…
