PELPHREY, Chief Justice.

In 1885 Thomas Inman, now deceased, was a widower with three small children. In that year he married appellee and they lived together as husband and wife until his death November 5, 1932. Appellant is one of the children of that marriage. During- the time the marriage relation existed, Thomas Inman and appellee purchased the property involved in this suit. That property consisted of two different tracts, the first one being lots 1, 2, and 3, block 17, Chaffin’s addition to the city of Sherman, Tex., on which the family residence is located, and lots 10,11, and 12,…
