Appeal from Union Circuit Court. Action to establish a mechanic’s lien. The court refused to do so, and dismissed the petition, and the plaintiff appeals.

The plaintiff furnished the defendant, Boggs, lumber for the erection of two houses he had contracted to construct for his co-defendant, C. E. Locke. In August, 1882, the plaintiff filed in the clerk’s office the statement required by law claiming the lien. On the second day of September, 1882, the defendant, Locke, caused to be served on the plaintiff a written demand to commence suit to enforce the lien.
