On a previous hearing of this controversy, which occurred on plaintiff's appeal from a judgment sustaining defendants' exceptions of no cause or right of action as to the damages claimed under the general tort law and dismissing the suit, we set aside the district court's judgment, overruling the exceptions, and remanded the case for further proceedings.10 So.2d 532, 535.
