BRANNON, Judge:
By deed of 30th October, 1885, David Myers leased to E. M. Ilukill and George P. Hukill for a term of twenty years a tract of three hundred acres of land in Monongalia eoun"ty for the purpose of producing oil, said deed containing a *642covenant on the part of the lessees “to commence operations for said purposes within one year from and after the execution of this lease, or to thereafter pay to said party of the first part twelve dollars per month until the work is commenced ; and a failure of the party of the second part to comply with either one or the other of the foregoing…
