This is an appeal from the order of the district court affirming the Basic Proration Order (BPO) of the Kansas Corporation Commission (KCC) pertaining to the Fincham O’Brien-Barby Morrow Gas Field in Meade County.

The facts from which this controversy arose are as follows: In October of 1983, appellant Zinke & Trumbo Ltd., drilled and began production of its O’Brien-Barby 1-32 gas well in the center of the NW/4 NW/4 of Section 32, Township 34S, Range 26W, Meade County.
