MEMORANDUM OPINION
MICHAEL, District Judge.
Plaintiff in this action is a Sergeant with the Virginia State Police. He alleges that *922his transfer from a duty station in Char-lottesville to one in Richmond, as well as the handling of his grievance of that action, violated his constitutional rights. Defendant has moved to dismiss this action under Fed.R.Civ.P. 12(b)(1), arguing that the court lacks subject matter jurisdiction over plaintiffs claims. Both parties submitted briefs and were heard at oral argument on May 15, 1990. This motion is now ripe for disposition.
