State v. Angelina Nicole Carlucci (069183)
Supreme Court of New Jersey
1Opinion of the Court
Judge RODRÍGUEZ
(temporarily assigned) delivered the opinion of the Court.
An inculpatory statement made by an accused prior to trial, and later introduced as evidence, may be very persuasive to a jury precisely because it comes from the mouth of the accused. In this appeal, defendant seeks reversal of a conviction for third-degree possession of cocaine, N.J.S.A. 2C:35-10a(l), by challenging several such statements on various grounds. We reverse defendant’s conviction on the sole basis that statements that should have been excluded pursuant to N.J.R.E. 404(b) were admitted in her trial.
