Payne brought this suit against the Kansas City, Mexico & Orient Railway Company of Texas, which we will designate as the “Orient,” and the Galveston, Harrisburg & San Antonio Railway Company, to recover damages to a shipment of 15 cars containing 808 head of cattle shipped from Marathon, Tex., to Hardy, Okl. The shipment moved from Marathon to Alpine, Tex., over the line of the second-named defendant; thence to destination over the line of the Orient and its connecting carriers.
