Ronald Eugene Smith (“Appellant”) appeals his conviction following a bench trial for one count of the Class C felony of possession of a controlled substance, a violation of section 195.202.1 The trial court sentenced Appellant as a prior and persistent offender to 10 years in the Missouri Department of Corrections.
