This defendant is a mutual benefit association. It was incorporated in the year 1873, and has existed as such up to date. The plaintiff is.suing the defendant to recover sick benefits claimed to be due from the month of October, 1899. The case has been tried three times. On the first occasion the jury disagreed. On the second trial the jury rendered a verdict for plaintiff, which was reversed and a new trial granted. An opinion was written, which is reported in 125 App. Div. 91, 109 N. Y. Supp. 101.
