ROBERTSON, Presiding Judge.

Jackie Davison appeals from the denial of her renewed motion for a judgment as a matter of law in an action filed by Barbara Pogue in the Mobile County Circuit Court. We reverse and remand with instructions.

Pogue filed her complaint on March 14, 1997, alleging that she had been injured in an automobile collision on or about March *124120, 1995. According to her complaint, one of the defendants, Alan R.
