Action by the city of Concord to recover on a bond issued by the defendant to indemnify plaintiff for loss caused by the failure of Thomas Pingree, its personnel and purchasing director, “to perform faithfully his duties.” The breach relied on is Pingree’s failure to request the Labor Commissioner to determine, in accordance with RSA ch. 280, the minimum wage rates to be paid in the construction of two municipal buildings.
