STATEMENT OF FACTS.

This action was commenced on the 6th day of June, 1899, by the defendant in error, Timken Carriage Co., a corporation doing business in St. Louis, Mo., by filing in the district court of Logan county, a petition alleging their corporate capacity under the laws of the state of Missouri, and that they were engaged in the business of manufacturing buggies, carriages and other vehicles.
