MEMORANDUM OPINION

SINGLETON, Chief Judge.

Plaintiff, Debra Lynn Clark, brings this action under the Civil Rights Act, 42 U.S.C. § 1983, the fourteenth amendment, and Texas common law, against defendants, 1 officials of Harris County, for the unlawful arrest of plaintiff based upon mistaken identity. This case was tried before the court on January 19-20,1982. The defendants offered no evidence and rested their case upon the conclusion of plaintiff’s case.
