MEMORANDUM AND ORDER

MAGNUSON, District Judge.

This matter is before the court on two motions. First, defendant Northwestern Mutual Life Insurance Company (NML) has brought an interpleader motion pursuant to Fed.R.Civ.P. 22. Second, plaintiffs Kathy Wittry and the estate of Florence M. Balk (the Estate) have brought cross-motions for summary judgment. For the reasons set forth below, the court grants defendant’s interpleader motion and grants summary judgment in favor of Kathy Wit-try.
