This action was for damages arising out of a collision between two motor vehicles at the intersection of two roads about eight miles south of Leon, Kan. Plaintiff was proceeding west in a truck driven by her husband; the defendant was traveling south on the.north-and-south road.

The accident was on August 14, 1938; suit was filed September 1, 1938, and the trial was held on May 27, 1940. The jury answered special questions and returned a verdict for defendant. Plaintiff’s motion for a new trial was overruled. The motion was based on the ground…
