^STATEMENT OF THE CASE:

On September 17, 2008, the defendant was charged with theft over $500.00. On October 3, 2008, the defendant entered a plea of not guilty. On March 11, 2009, the district court found no probable cause to hold defendant for trial. On June 30, 2009, following a bench trial, the defendant was found guilty as charged. On July 7, 2009 and September 28, 2009, the district court denied defense counsel’s motion for a new trial.
