The statement found in appellant’s brief is correct, and we adopt same as follows:

“This is a suit brought in the district court of Hunt county by appellee for personal injuries alleged to have been received by him while riding upon a car driven by a gasoline motor upon the track of appellant, in the nighttime, caused by the collision between the car upon which he was riding and another motorcar traveling in the opposite direction.
