The plaintiffs appeal the trial court’s dismissal of their claims against defendant doctors who performed foot surgery on them minor child. The trial court denied their motion for new trial after maintaining defendants’ exception of prescription.

This is a medical malpractice action involving foot surgery on a ten-year-old boy, Hunter Fortier, with spina bifida that caused spinal nerve damage to his feet and ankles. Dr. MacEwen at Children’s Hospital had performed several surgeries on the boy over the period of 1987 through 1993 to correct problems of limited sensation…
