This is an action against the United States under the Federal Tort Claims Act. 1 Plaintiff, a resident of Chicago, sues here, where the act complained of occurred. 2 The case was tried to the court. 3

I. The following are the facts: On the afternoon of October 15, 1953, plaintiff, Russell J. Crouse, was proceeding in a northerly direction in the State of Delaware on Route 13, a 4-lane dual highway separated by a grass plot, in a vehicle owned and operated by John C. Gardner.
