April 21, 1919, Hiram S. Compton, appellee, and Oscar Weber, appellant, entered into a written contract whereby appellant agreed to sell and appellee agreed to buy certain farm lands in Iroquois county, Illinois. Appellee agreed to pay for the farm $25,000,—$3000 at the execution of the contract and $22,000 February 20, 1920,—and to assume a mortgage debt of $5000. Appellant agreed to deliver to appellee, on or before February 10, 1920, an abstract showing a merchantable title of record in appellant and to convey the premises to appellee by warranty deed February 20, 1920.
