This is an action for return of a $500 deposit given to the defendant as partial payment for the purchase of a new truck.

Plaintiff and three of his friends visited defendant’s automobile showroom. Plaintiff, in the presence of his witness, discussed the purchase of a pickup truck with a salesman named Kenyan.
