This case is before the Court to determine the appropriate remedy to address the procedural violation of the Administrative Procedure Act (“APA”), 5 U.S.C. § 553, by the defendants Thomas E. Perez 1 , in his official capacity as Secretary of Labor, and the U.S. Department of'Labor (collectively, “Federal Defendants”).
