This was a proceeding commenced by plaintiff in error against defendants in error at the August term, 1869, of the Circuit Court of Henderson county, under the provisions of an act entitled: “ An act to provide for a permanent survey of lands,” approved March 25th, 1869. Sess. Laws, page 241; and being commenced while said act was in force, is to be considered as though the statute had not been repealed.
