Appeal from an order of the Supreme Court (Mc-Grath, J.), entered January 29, 2013 in Rensselaer County, which denied defendants’ motion for summary judgment dismissing the complaint.

Plaintiff was seriously injured when the vehicle in which she was a passenger collided with an unlicensed vehicle being pursued at high speed by defendant Thomas Jones, a police officer with defendant Village of Nassau Police Department.
