Under authority of section 25 of article 7 of the Constitution, the Court of Appeal for the Second Circuit (123 So. 631) has applied for instructions on the question of law on which this case depends. A woman died, intestate, leaving neither father nor mother, nor legitimate descendants, but survived by her husband and by two duly acknowledged illegitimate children, who were born before she was married, and who are not the children of her husband.
