delivered the opinion of the Commission of Appeals, Section A.

On December 13, 1921, John D. McDermett executed his promissory note to T. T. McDermett, due one year after date. To secure payment of the note he executed a deed of trust to Henry Wilkinson, as Trustee, which conferred on the trustee the usual power of sale, and recited the note and its maturity date. This deed of trust covered certain lands in Deaf Smith County, and was filed for record January 23, 1922. About this time, the note was endorsed by T. T.
