Movant appeals from the denial of his Rule 27.26 motion after an evidentiary hearing.
Movant was charged with felony murder and assault with intent to kill with malice aforethought, arising from the killing of Harry Shelton and the wounding of a police officer on December 31,1976, in the City of St. Louis. At his first trial, movant was convicted of the assault on the police officer for which he was sentenced to a term of 75 years, but the jury could not reach a verdict on the homicide charge.
