This appeal arises out of an action by an elected official seeking to be removed from the rolls of the Kansas Public Employees Retirement System (KPERS).

The plaintiff, Geary N. Gorup, became a member of KPERS on September 1, 1976, while serving as a nonelected official (assistant county attorney) of Butler County, Kansas, a participating employer. While serving in that capacity he was elected county attorney. He continued to serve as assistant county attorney until he took office as county attorney on January 10, 1977.
