OPINION AND ORDER

CASELLAS, District Judge.

Before the Court is Defendant’s motion for partial summary judgment (Docket # 33). Plaintiff has duly opposed said motion (Docket #36), and Defendant has filed a reply (Docket # 41). Having con sidered the parties’ arguments and the relevant case law, Defendant’s motion will be GRANTED.
