A Jasper County jury found defendant guilty of carrying a concealed weapon in violation of the first clause of § 564.6101 but could not agree upon punishment. Per Rule 27.03, the court fixed punishment at three years’ imprisonment and defendant appealed.

First, we have a problem which must be resolved sua sponte. State v. McIntyre, 542 S.W.2d 793, 794 (Mo.App.1976). The verdict was returned April 26, 1977.
