These cases have been consolidated for decision on appeal as they all relate to issues involved in the disposition of the assets of Bernard F. Diamond who died on October 12, 1969. Cases 28081 and 28082 are an appeal and cross appeal from an order of the trial court overruling appellants’ motion for judgment notwithstanding a mistrial in the probate contest case of the alleged last will and testament of Mr. Diamond.
