This was an action of ejectment brought by the defendant in error, who was plaintiff below, for the recovery of a small piece of ground situate on the éasterly side of Cherry street, in the city of Philadelphia, in what was formerly known as the district of Kensington. The first assignment of error, on the record, is, “ that the judge refused to charge that the paper title of the plaintiff in error, defendant below, is superior to that of *124the defendant in error and plaintiff below.” Both parties derive title for the ground in question from…
