Appeal from an order of the district court discharging a writ of habeas corpus.

The facts are not in dispute. Relator was convicted, on his plea of guilty, of the crime of assault with intent to commit rape and was sentenced to an indeterminate term of imprisonment in the state reformatory at St. Cloud on July 1, 1948. On August 2, 1948, he was brought before the probate court of Sherburne county upon a petition signed by Dr. L. A. Veranth, resident physician at the Minnesota state reformatory, alleging that he was mentally ill and unsuited for reformatory care and that he…
