An indictment was filed against petitioner Harry Ming, and codefendants Wildenhus, Stout, Ryan, Layton and Brown, charging them in count I with possession of marijuana for sale (Health & Saf. Code, § 11530.5); in count II with conspiracy to sell marijuana (Pen. Code, § 182); and in count III with sale of marijuana (Health & Saf. Code, § 11531).
