This is an action in trespass brought in the year 1923 by the Archibald McNeil & Sons Company, Inc., of New York, plaintiff, against the Western Maryland Railway Com*670pany, defendant, to recover damages for an alleged unreasonable preference or discrimination in violation of sections 3,. 8, and 9 of the Act of Congress of February 4, 1887, 24 Stat. 379, now known, with amendments, as the Interstate Commerce Act (49 USCA §§ 3, 8, 9).
